Gist of Guidelines

• Non-Red category MSMEs that have obtained Certificates of In-Principle Approval under the Kerala MSME Facilitation Act 2019 are exempted from obtaining building permits, trade licenses, and other statutory approvals for a period of 3.5 years from the date of approval.
• During this period, the In-Principle Approval certificate serves as a valid substitute for the required approvals and the entrepreneurs are required to obtain the required approvals within the expiry of this period.
• The Government has now issued guidelines vide G.O.(Ms) No. 82/2026/LSGD dated 11.03.2026 for facilitating the smooth transition of such enterprises.
• As per the guidelines, units whose 3.5-year period have already expired but haven't applied yet for the mandatory licenses from local bodies, are granted a one-time 6-month’s window from the date of the aforesaid G.O (11-03-2026) to submit their applications.
• Enterprises failing to apply within the 6-month window will be treated as unauthorised operations/constructions, and authorities will take legal action as per existing laws.
• For incomplete constructions, permits will be extended up to 5 years from the date of the In-Principle Approval. For completed buildings, a completion report and plan must be submitted.
• Only the standard prescribed fees for permits and occupancy certificates will be charged. Regularisation penalties/fees will not be levied.
• Property tax will be assessed based on the occupancy certificate date or the actual date the business started operating. Penal interest (fine) will not be charged for periods where a demand notice was not previously issued.
• The Certificate In-Principle Approval will be treated as a validly obtained license/registration and the LSGD will renew the license for the subsequent period upon submission of application.

മാർഗ്ഗനിർദ്ദേശങ്ങളുടെ സംഗ്രഹം

• 2019-ലെ കേരള സൂക്ഷ്മ ചെറുകിട ഇടത്തരം വ്യവസായ സ്ഥാപനങ്ങൾ സുഗമമാക്കൽ ആക്ട് പ്രകാരം "തത്വത്തിലുള്ള അംഗീകാര സാക്ഷ്യപത്രം" നേടിയ സംരംഭങ്ങൾക്ക്, അത് ലഭിച്ച തീയതി മുതൽ മൂന്നര വർഷക്കാലത്തേക്ക് കെട്ടിട നിർമ്മാണ പെർമിറ്റുകൾ, വ്യാപാര ലൈസൻസുകൾ, മറ്റ് ചില അംഗീകാരങ്ങൾ എന്നിവ നേടുന്നതിൽ നിന്നും ഒഴിവാക്കൽ നൽകിയിട്ടുണ്ട്.
• ഈ കാലയളവിൽ, ആവശ്യമായ അംഗീകാരങ്ങൾക്ക് പകരമുള്ള സാധുവായ രേഖയായി "തത്വത്തിലുള്ള അംഗീകാര സാക്ഷ്യപത്രത്തെ" പരിഗണിക്കും; എങ്കിലും ഈ സമയപരിധി അവസാനിക്കുന്നതിന് മുൻപായി സംരംഭകർ നിയമപരമായ എല്ലാ അനുമതികളും നേടിയെടുക്കേണ്ടതുണ്ട്.
• ഇത്തരം സംരംഭങ്ങളുടെ സുഗമമായ മാറ്റം ഉറപ്പാക്കുന്നതിനായി സർക്കാർ 11.03.2026 തീയതിയിലെ സ.ഉ.(കൈ) നം. 82/2026/LSGD ഉത്തരവ് പ്രകാരം മാർഗ്ഗനിർദ്ദേശങ്ങൾ പുറപ്പെടുവിച്ചിട്ടുണ്ട്.
• ഈ മാർഗ്ഗനിർദ്ദേശങ്ങൾ പ്രകാരം, മൂന്നര വർഷത്തെ കാലാവധി ഇതിനോടകം കഴിഞ്ഞിട്ടും അപേക്ഷ സമർപ്പിക്കാത്ത സംരംഭങ്ങൾ, ഉത്തരവ് തീയതിയായ 11.03.2026-ൽ നിന്നും ആറ് മാസത്തിനകം, ചട്ടങ്ങളിൽ പ്രതിപാദിക്കുന്ന വിധം നിശ്ചിത ഫോറത്തിൽ, അതത് തദ്ദേശ സ്വയംഭരണ സ്ഥാപനത്തിൽ അനുമതി അപേക്ഷ സമർപ്പിക്കേണ്ടതാണ്.
• അനുവദിച്ച 6 മാസത്തെ സമയപരിധിക്കുള്ളിൽ അപേക്ഷിക്കാൻ വീഴ്ച വരുത്തുന്ന സംരംഭങ്ങളെ അനധികൃത നിർമ്മാണങ്ങളായോ/ പ്രവർത്തനങ്ങളായോ കണക്കാക്കുകയും അവർക്കെതിരെ നിലവിലുള്ള നിയമങ്ങൾക്കനുസൃതമായി നടപടികൾ സ്വീകരിക്കുകയും ചെയ്യുന്നതായിരിക്കും.
• നിർമ്മാണം പൂർത്തിയാകാത്ത കെട്ടിടങ്ങൾക്ക്, "തത്വത്തിലുള്ള അംഗീകാര സാക്ഷ്യപത്രം" ലഭിച്ച തീയതി മുതൽ 5 വർഷം വരെ കാലാവധി നൽകി പെർമിറ്റുകൾ അനുവദിക്കും; നിർമ്മാണം പൂർത്തിയായ കെട്ടിടങ്ങൾക്ക് കംപ്ലീഷൻ റിപ്പോർട്ടും പ്ലാനും സമർപ്പിക്കേണ്ടതാണ്.
• പെർമിറ്റുകൾക്കും, ഒക്കുപൻസി സർട്ടിഫിക്കറ്റുകൾക്കും നിശ്ചയിച്ചിട്ടുള്ള സാധാരണ ഫീസ് മാത്രമേ ഈടാക്കുകയുള്ളൂ; പ്രത്യേക ക്രമവൽക്കരണ പിഴകളോ ഫീസോ ഈടാക്കുന്നതല്ല.
• ഒക്കുപൻസി സർട്ടിഫിക്കറ്റുകൾ ലഭിച്ച തീയതിയോ അല്ലെങ്കിൽ സ്ഥാപനം യഥാർത്ഥത്തിൽ പ്രവർത്തനം ആരംഭിച്ച തീയതിയോ അടിസ്ഥാനമാക്കി വസ്തു നികുതി നിർണ്ണയിക്കുന്നതാണ്. ഡിമാൻഡ് നോട്ടീസ് മുൻകൂട്ടി നൽകാത്ത കാലയളവിലെ നികുതിക്ക് പിഴപ്പലിശ ഈടാക്കില്ല.
• തത്വത്തിലുള്ള അംഗീകാര സാക്ഷ്യപത്രം" സാധുവായ ലൈസൻസായോ രജിസ്ട്രേഷനായോ പരിഗണിക്കും; അപേക്ഷ സമർപ്പിക്കുന്ന മുറയ്ക്ക് തദ്ദേശ സ്വയംഭരണ സ്ഥാപനങ്ങൾ തുടർന്നുള്ള കാലത്തേക്ക് ലൈസൻസ് പുതുക്കി നൽകുന്നതാണ്.
